# TERMS OF SERVICE
## 1. About These Terms
These Terms of Service ("Terms") govern your use of the website located at www.coloradosoccerbuddies.com (the "Site"), your enrollment in Colorado Soccer Buddies classes, camps, parties, and programs (the "Programs"), and your participation in our text messaging program (the "SMS Program").
The Site and the Programs are operated by SOCCER BUDDIES, doing business as Colorado Soccer Buddies ("Colorado Soccer Buddies," "Soccer Buddies," "we," "us," or "our"), a Colorado business located at 2450 Canada Dr, Colorado Springs, Colorado 80915.
By using the Site, enrolling in a Program, or opting in to the SMS Program, you agree to these Terms. If you do not agree, please do not use the Site or enroll in our Programs.
These Terms should be read together with our [Privacy Policy](https://www.coloradosoccerbuddies.com/privacy-policy), which explains how we collect, use, and protect your information.
## 2. Who May Use This Site and Enroll
The Site and enrollment process are intended for adults 18 years of age or older. Because our Programs serve young children, all registrations, communications, consents, and payments must be completed by a parent or legal guardian who is at least 18 years old.
Children do not create accounts, register themselves, or receive text messages from us. We do not knowingly collect personal information directly from children under 13. See the Children's Privacy section of our Privacy Policy.
## 3. Program Enrollment, Pricing, and Payment
Class registration is handled through our registration portal (iClassPro) and, where applicable, our online store. By enrolling, you agree to:
- Provide accurate and complete registration information, including the name and age of the participating child and a working phone number and email address for the parent or guardian.
- Pay all applicable tuition, session fees, and party or camp fees at the rates published at the time of enrollment. Pricing is available at www.coloradosoccerbuddies.com/pricing and is subject to change.
- Authorize us or our payment processor to charge the payment method on file for fees you incur, including recurring session or membership charges where you have enrolled in a recurring program.
We reserve the right to cancel, combine, reschedule, or relocate a class or session due to low enrollment, facility availability, weather, staffing, or other operational needs. Where a class is cancelled by us, we will offer a make-up, credit, or refund consistent with the policies above.
## 4. Participation, Safety, and Waiver
Youth soccer involves physical activity and a risk of injury. Participation requires a signed waiver and release of liability, which is collected during registration and is incorporated into these Terms by reference.
Parents and guardians agree to:
- Remain on site and reachable during their child's class unless the Program specifies otherwise.
- Disclose any medical condition, allergy, or accommodation need relevant to safe participation.
- Follow the reasonable instructions of our coaches and facility partners.
We may remove a participant from a class or Program, without refund, for conduct that endangers other children, staff, or facility property.
## 5. Photo and Media
We may photograph or record classes and events for promotional purposes. If you do not want your child photographed or recorded, notify us in writing at info@coloradosoccerbuddies.com and note it on your registration, and we will honor that request.
## 6. Text Messaging Program (SMS Terms and Conditions)
**This section, together with our Privacy Policy, constitutes the full terms of our SMS Program.**
### 6.1 Program Description
By providing your mobile number and affirmatively consenting, you agree to receive text messages from Colorado Soccer Buddies at the number provided, including messages sent using an automatic telephone dialing system or other automated technology.
Messages may include:
- **Customer care and transactional messages:** registration and enrollment confirmations, class reminders, schedule changes, weather cancellations and field closures, coach and location updates, payment receipts and billing notices, and responses to questions you send us.
- **Marketing and promotional messages:** free trial follow-up, open enrollment announcements, new session and new location launches, camp and birthday party offers, referral programs, and seasonal promotions.
### 6.2 How You Opt In
Consent is collected only through your own affirmative action, such as:
- Checking an unchecked consent box on a form on our Site, landing page, or registration portal where you enter your mobile number;
- Submitting our Free Trial or contact form with the SMS consent disclosure displayed;
- Texting one of our published keywords or numbers first; or
- Providing your number verbally or in writing to our staff and agreeing to receive texts.
**Your consent to receive marketing text messages is not a condition of purchase or of enrolling in any Program.** You may enroll, pay, and participate without agreeing to marketing texts.
We do not obtain phone numbers from purchased lists, rented lists, or third-party lead sellers, and we do not text numbers that were shared with us by another company.
### 6.3 Message Frequency
Message frequency varies based on your enrollment status and the Programs you are interested in. You may receive up to approximately [10] messages per month. Transactional messages, such as a weather cancellation, are sent as needed and may increase this number.
### 6.4 Message and Data Rates
**Message and data rates may apply.** Text messages are sent to the mobile number you provide, and your mobile carrier's standard messaging and data charges apply to every message sent and received. Contact your wireless provider for details about your plan.
### 6.5 How to Opt Out
**You can cancel at any time. Reply STOP to any message from us.** After you send STOP, we will send you a single confirmation that you have been unsubscribed, and you will receive no further text messages from us unless you opt in again.
You may also opt out by emailing info@coloradosoccerbuddies.com or calling (719) 330-9642. Opting out of text messages does not remove you from email communications, and does not by itself cancel a class enrollment or a recurring payment — contact us directly to change your enrollment.
### 6.6 How to Get Help

### 6.7 Carrier Liability and Delivery
**Carriers are not liable for delayed or undelivered messages.** Message delivery is subject to effective transmission by your wireless carrier and to network conditions outside our control, and we cannot guarantee that any message will be delivered or delivered on time.
Because delivery cannot be guaranteed, you should not rely solely on text messages for time-sensitive information. Class cancellations and schedule changes are also posted to our Site and sent by email.
### 6.8 Devices, Numbers, and Changes
Not all mobile devices or handsets support text messaging, and our SMS Program may not be available on all carriers. You represent that you are the account holder or authorized user of the mobile number you provide, and that you are at least 18 years old. You agree to notify us promptly if your mobile number changes or is reassigned so that we do not message a subsequent user of that number.
### 6.9 Privacy
Your mobile number and your SMS consent are handled as described in our [Privacy Policy](https://www.coloradosoccerbuddies.com/privacy-policy). **No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.** Mobile information is shared only with the service providers who help us deliver messages and operate our business, and only for that purpose.
## 7. Acceptable Use of the Site
You agree not to use the Site to: violate any law; submit false, misleading, or another person's information; interfere with or disrupt the Site or its security; scrape, harvest, or collect data about other users; or transmit malicious code.
## 8. Intellectual Property
The Site and its content — including the Soccer Buddies name, logos, curriculum, class descriptions, photographs, and copy — are owned by us or our licensors and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written permission.
## 9. Third-Party Services and Links
Our Site links to and relies on third-party services, including our registration portal, payment processors, and our online store. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content, practices, or policies of third-party sites.
## 10. Disclaimers
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
## 11. Limitation of Liability
To the fullest extent permitted by law, SOCCER BUDDIES and its owners, employees, coaches, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of your use of the Site, the SMS Program, or the Programs. Our total liability for any claim relating to the Site or the SMS Program will not exceed the amount you paid to us in the twelve months before the claim arose.
Nothing in this section limits liability that cannot be limited under applicable law, and this section does not supersede the terms of the participation waiver referenced in Section 4.
## 12. Indemnification
You agree to indemnify and hold harmless SOCCER BUDDIES and its personnel from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the Site or the Programs.
## 13. Governing Law and Disputes
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules. Any dispute arising out of these Terms or the Programs will be brought exclusively in the state or federal courts located in El Paso County, Colorado, and you consent to the jurisdiction of those courts.
## 14. Changes to These Terms
We may update these Terms from time to time. We will post the revised version on this page and update the "Last Updated" date. Material changes to the SMS Program will be communicated to enrolled subscribers. Your continued use of the Site or the SMS Program after a change takes effect means you accept the revised Terms.
## 15. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and any waiver or registration agreement you sign, constitute the entire agreement between you and us regarding the Site, the SMS Program, and the Programs.
